You will:
i) co-operate with the staff of the Client and PromoPower and will accept the direction, supervision and instruction of any responsible person in the Client’s or PromoPower organisations or who is authorised by the Client or PromoPower;
ii) observe any rules and regulations of the workplace or relating to the Project to which attention has been drawn or which you might reasonably be expected to ascertain. Whilst engaged on a Project you will perform your duties to the best of your ability and endeavour to maintain the good reputation of both the Client and PromoPower;
iii) unless arrangements are made to the contrary, conform to the hours as set out in this Project confirmation;
iv) take all reasonable steps to safeguard your own safety and the safety of any other person who may be present or affected by your actions on the project and comply with the Health & Safety policy of the work place or of PromoPower;
v) not engage in any conduct detrimental to the interests of the Client or PromoPower;
vi) advise PromoPower if offered employment or other engagements direct with the Client and provide details of any remuneration offered by the Client; and
vii) adhere to PromoPower disciplinary code as written in the company hand book.
REMUNERATION
Subject to any statutory entitlement, you will not be paid by PromoPower or the Client for time not spent on the project whether in respect of holidays, illness or absence for any other reason.
TIMESHEETS
At the end of each week of a project (or at the end of the project where the project is for a period of less than one week or is completed before the end of a week), you will deliver PromoPower to the PromoPower a pay claim form indicating the number of hours/days worked by you during the preceding week and signed by an authorised representative of PromoPower or the Client. PromoPower will not be obliged to make any payment to you unless a properly authenticated pay claim form has been submitted. Expenses will be payable provided they have been authorised in advance by PromoPower and receipts are received. These expenses must be wholly, exclusively and necessarily incurred in the performance of your duties.
TERMINATION
a) If you behave in a manner which could or does bring PromoPower or its Client into disrepute (or in any other manner amounting to gross misconduct), your employment may be terminated immediately without any further payment being due to you.
b) PromoPower may terminate your employment without notice at any time if the project is of four weeks' duration or less. If the project is for four weeks or more, PromoPower shall be entitled to end your employment early for any reason on giving one week's notice to you, save in the circumstances of a) above when no notice shall be given.
c) You will be obliged to give PromoPower one week's notice if you wish at any stage to terminate your employment.
d) If employment is terminated in accordance with clauses a) to c) above, any completion bonus referred to on the front of this document shall not be payable.
e) If you are unable for any reason to work on a project, you must inform PromoPower by no later than 7.30 a.m. on the first day of absence (including at weekends) to enable alternative arrangements to be made.
f) If you have a grievance in relation to your employment, this must be raised immediately with either your Line Manager or a Director of PromoPower. If you wish to appeal against any disciplinary decision taken in relation to you, you should raise this in writing within five working days with your Line Manager or, if the decision against which you are appealing was taken by your Line Manager, with a Director of PromoPower.
GENERAL
a) You will inform PromoPower if at any time a complaint is brought by a Client or the general public against you or if you have been charged with a criminal offence.
b) You will not at any time divulge to any person, or use for your own or any person’s benefit, any confidential information in relation to the Client’s or PromoPower employees, business affairs, transactions or finances.
c) PromoPower shall be entitled to vary these Terms and Conditions of employment if necessary to comply with the provisions of new legislation that may be brought into force during a project.
d) There are no collective agreements in force, which affect (directly or indirectly) the terms and conditions of your employment.
e) You will not be required to work outside the United Kingdom and accordingly no terms and conditions regarding overseas work are applicable to your employment.
PENSION SCHEME
There is no pension scheme at present in respect of your employment. PromoPower has not contracted out for National Insurance purposes.
